Terms of Service

By creating an account, making a booking, or otherwise using the Ghaws platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Ghaws.

Ghaws is a digital marketplace platform that connects divers with licensed dive centers across Saudi Arabia's Red Sea and Arabian Gulf coastlines. We facilitate trip discovery, booking, and payment processing. Ghaws does not directly operate dive trips, provide diving instruction, or own/operate dive vessels. All diving services are provided by independent, licensed dive centers listed on our platform.

To use certain features, you must create an account using your phone number and OTP verification via SMS. You agree to: • Provide accurate and complete information • Keep your account credentials secure • Be at least 18 years old, or have parental consent if between 14-18 • Not create multiple accounts or share account access • Notify us immediately of any unauthorized access We reserve the right to suspend or terminate accounts that violate these Terms.

When you make a booking through Ghaws: • You enter into an agreement with the dive center for the specific trip/service • Bookings are subject to availability and capacity limits • Confirmation is provided via email and in your account dashboard • Cancellation policies are set by individual dive centers and displayed before booking • You must arrive at the designated meeting point at the specified time • Failure to attend (no-show) is subject to the center's cancellation policy

All payments are processed in Saudi Riyals (SAR) through our payment partner Moyasar, which is regulated by the Saudi Arabian Monetary Authority (SAMA). We accept: • Credit and debit cards (Visa, Mastercard) • mada debit cards • Bank transfers (for select bookings) Payment is required at the time of booking. Refunds are processed according to the dive center's cancellation policy and may take 5-14 business days to appear in your account.

Dive centers listed on Ghaws are independently operated and are responsible for: • Maintaining valid commercial registrations and diving licenses • Ensuring safety equipment and protocols meet industry standards • Verifying participant certifications and medical fitness • Providing accurate trip descriptions, pricing, and schedules • Complying with all applicable Saudi regulations and maritime laws

As a user of Ghaws, you are responsible for: • Providing accurate personal information, including valid ID documents • Holding valid diving certifications appropriate for your booked activities • Disclosing relevant health conditions through the medical screening process • Following all safety instructions from dive center staff and trip leaders • Ensuring your equipment is in safe working condition if bringing your own • Complying with local laws and regulations at all dive sites

For boat and liveaboard trips in Saudi waters, Ghaws facilitates compliance with the Zawil Sailing Permit system operated by the Saudi Coast Guard through ELM. By booking such trips, you consent to: • Submission of your ID information for sailing permit issuance • Compliance with Coast Guard safety requirements • The captain's authority in all matters of vessel safety • Possible itinerary changes due to weather or safety conditions

The Ghaws name, logo, platform design, content, and all associated intellectual property are owned by Ghaws. You may not copy, modify, distribute, or create derivative works from our platform without written permission. User-generated content (reviews, photos, dive logs) remains your property, but you grant Ghaws a non-exclusive license to display it on the platform.

Ghaws is a marketplace platform and does not directly provide diving services. To the maximum extent permitted by law: • Ghaws is not liable for injuries, accidents, or losses during diving activities • Ghaws is not liable for the actions or negligence of dive centers or their staff • Our total liability is limited to the amount you paid for the specific booking in question • We are not liable for indirect, incidental, or consequential damages Diving involves inherent risks including serious injury or death. Participants acknowledge these risks through our waiver process.

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. The Saudi E-Commerce Law and its implementing regulations apply to all transactions conducted through our platform.

In the event of a dispute: 1. Contact us at info@ghaws.ai to attempt informal resolution 2. If unresolved within 30 days, disputes may be escalated to the Saudi Center for Commercial Arbitration (SCCA) 3. The courts of the Kingdom of Saudi Arabia shall have exclusive jurisdiction for any legal proceedings For booking-specific disputes with dive centers, Ghaws will assist in mediation but is not a party to the service agreement between you and the center.

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of Ghaws after changes are posted constitutes acceptance of the updated Terms. If you disagree with changes, you may close your account.
